The first phase of the project included field research in Turkana South and Turkana East, dubbed “Listening Project” that sought to: identify the key stakeholders in the grievance mechanism sector; listen to and document community perceptions, knowledge and expectations of community grievances unique to each stage of the extractives value chain; and their preferred grievance handling mechanisms. This was followed by a five-day training of High Court judges and legal researchers, conducted in partnership with the JTI and IDLO, in November 2018 to build their capacity to understand and resolve complex issues arising from the extractive sector.
Based on the feedback from judges and the Listening Project findings, the EB has successfully developed the Judiciary Guide on Extractives to provide a quick and detailed guidance/ reference for judicial officers in understanding the extractives sector value chain (oil, gas and mining), attendant grievances and diverse grievance handling models for the judiciary to undertake at each stage, including the interface between judicial and non-judicial (ADR) mechanisms.
